HOUSE BILL 1269-FN
AN ACT requiring the department of health and human services to
                compile and maintain abortion statistics.

ANALYSIS:     This bill requires the department of health and human services to keep an annual
                           statistical report of each abortion performed.

STATE OF NEW HAMPSHIRE     In the Year of Our Lord Two Thousand One
AN ACT requiring the department of health and human services to compile and
maintain abortion statistics.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Section; Report Required. Amend RSA 126-A by inserting after section 4-a
the following new section:

    126-A:4-b Abortions; Report.

        I. In this section:

            (a) "Abortion" means the use of any instrument, medicine, drug or any other
                substance or device to terminate the pregnancy of a woman known to be
                pregnant with an intention other than to increase the probability of a live
                birth, to preserve the life or health of the child after live birth, or to remove
                a dead fetus.

            (b) "Facility" or "medical facility" means any public or private hospital, clinic,
                center, medical school, medical training institution, health care facility,
                physician's office, infirmary, dispensary, ambulatory surgical treatment
                center, or other institution or location wherein medical care is provided
                to any person.

            (c) "Practitioner" means any person performing an abortion in any facility.

    II. A report of each abortion performed shall be made to the department on forms
        adopted by rule under  RSA 541-A. The department shall create the necessary
        forms within 30 days after January 1, 2003. The report forms shall not identify
        the individual patient by name and shall include the following information:

            (a) Identification of the practitioner who performed the abortion and of a
                referring physician, agency, or service, if any.

            (b) Identification of facility where the abortion was performed, including
                city and county where located.

            (c) The county and state in which the woman resides.

            (d) The woman's age, race, and marital status.

            (e) The type of abortion procedure performed or prescribed, including RU 486.

            (f) Date on which the abortion was performed.

   III. The reports shall be completed in triplicate by the hospital or other licensed
        facility, signed by the practitioner who performed the abortion, and transmitted
        to the department within 15 days after the end of each reporting month. One
        copy shall be given to the patient, one copy shall be retained by  the facility,
        and one copy shall be filed with the department.

   IV. The department shall prepare a comprehensive annual statistical report based
        upon the data gathered under this section. Such report shall not lead to the
        disclosure of the identity of any person filing a report or about whom a report
        is filed.

2 Effective Date. This act shall take effect January 1, 2003.

FISCAL IMPACT:   The Office of Legislative Budget Assistant is unable to
complete a fiscal note for this bill as it is awaiting information from an agency.
